ALBANY ? Gov. Andrew Cuomo says he has issued an executive order directing state agencies to increase energy efficiency in state buildings by 20 percent in seven years.
The administration says it has an implementation plan that will set project priorities based on energy savings per dollar spent, expected to address the most inefficient buildings first.
The New York Power Authority has committed to provide $450 million in low-cost financing.
According to the governor?s office, most projects will require no capital spending upfront, with agencies expected to repay loans through energy savings.
The order also applies to public authorities and commissions where Cuomo appoints the leadership.
The April 1, 2020, energy goal is 20 percent below average energy use of those buildings in fiscal 2010-2011.

PARIS (AP) ? Embattled French President Francois Hollande suffered a fresh setback Saturday when France's highest court threw out a plan to tax the ultrawealthy at a 75 percent rate, saying it was unfair.
In a stinging rebuke to one of Socialist Hollande's flagship campaign promises, the constitutional council ruled Saturday that the way the highly contentious tax was designed was unconstitutional. It was intended to hit incomes over ?1 million ($1.32 million).
The largely symbolic measure would have only hit a tiny number of taxpayers and brought in an estimated ?100 million to ?300 million - an insignificant amount in the context of France's roughtly ?85 billion deficit.
Prime Minister Jean-Marc Ayrault was quick to respond, saying in a statement following the decision the government would resubmit the measure to take the court's concerns into account. The court's ruling took issue not with the size of the tax, but with the way it discriminated between households depending on how incomes were distributed among its members. A household with two earners each making under ?1 million would be exempt from the tax, while one with one earner making ?1.2 million would have to pay.
The French government approved the tax in its most recent budget, amid criticism by some that it would do little to stem the country's mounting fiscal problems and would drive away the wealthiest citizens. Hollande's popularity, meanwhile, has been tanking as the country's unemployment continued its rise for the 19th straight month.
In recent weeks, Gerard Depardieu ? France's most famous actor ? announced his intention to turn in his French passport and move to a village in a tax-friendly Belgium.

Instagram had a sharp drop in users on Christmas day, and it hasn't recovered, according to AppData, a site that tracks application usage.
AppData only tracks users who are logged into Instagram through Facebook.?You don't have to log in through Facebook to use Instagram. As a result, the AppData results are only a portion of Instagram's overall usage. Therefore, the absolute numbers AppData reports are meaningless. However, the trends are interesting.
And as you can see, there was strange drop on Christmas day.
The New York Post is blaming Instagram's change in terms of service for the drop. That doesn't make sense since the terms of service flap started on December 17, and ended three days later. AppData updates its stats on a daily basis.
But, AppData tells the Post, "[We are] pretty sure the decline in Instagram users was due to the terms of service announcement."
We've emailed Facebook, which owns Instagram, and AppData for comment. If we get anything back from them, we'll update this post.
We have no explanation for the drop. (Personally, I was using Instagram more around Christmas, and so were my friends.)

SYDNEY (AP) ? In the exploding hell of battle, a single hand poked through the earth.
John Cantwell could see the ridges and calluses of the skin, and the pile of desert sand that had swallowed the rest of the Iraqi soldier. The troops Cantwell was fighting alongside in the Gulf War had used bulldozing tanks to bury the man alive.
This hand ? so jarringly human amid the cold mechanics of bombs and anonymous enemies ? was about to wedge itself, the Australian man would write decades later, "like a splinter under the skin of my soul." It would lead, along with other battlefield horrors, to the splintering of his mind and to a locked psychiatric ward. And it would lead to the abrupt end of a 38-year military career that saw him ascend to remarkable heights as the commander of Australia's 1,500 troops in Afghanistan.
In the process, Maj. Gen. Cantwell would become two people: a competent warrior on the outside. A cowering wreck on the inside.
He hid his agony to survive, to protect his loved ones and ? he admits it ? to pursue professional glory. But in the end, the man with two selves found he had lost himself completely.
A disheartening number of veterans suffer post-traumatic stress disorder. What made Cantwell so extraordinary was his ability to hide his escalating pain for so long, while simultaneously soaring through the military's ranks ? eventually taking charge of an entire nation's troops in a war zone.
But the higher he climbed, the farther he fell into the abyss of mental illness.
"I became an excellent actor," he says, 20 years into his battle with PTSD and going public for the first time with the release of his autobiography, "Exit Wounds."
"It did, though, come at a price. It was like pressure building in a hose and you finally release the tap."
And when that tap was opened, Cantwell nearly drowned.

IRAQ
He had practically begged his way onto the battlefield.
In 1974, he joined Australia's Army as a 17-year-old private, after a childhood spent worshipping Vietnam veterans and poring over military-themed comic books. He ended up on exchange with the British Army, and two years later, the Gulf War erupted. Cantwell hounded his superiors for his first chance at combat. "Be careful what you wish for, John," one warned him. But on Dec. 17, 1990, he said goodbye to his wife and two sons and headed to the Persian Gulf.
It was exciting at first ? the strategizing, the explosions, the sense of being part of something big. He whooped with victory alongside his comrades when bombs blew apart Iraqi artillery.
Then came the hand.
Cantwell stared at it as his tank rolled past. He had been unnerved by the plan for American troops to bulldoze over a network of trenches hiding Iraqi soldiers, but had said nothing. Now he wondered: Had the soldier been reaching for help when he was entombed?
The U.S. Defense Department would later defend the operation as a necessity of war, arguing that the Iraqis who were killed had chosen to stay in the trenches and fight. The Defense Department's former spokesman, Pete Williams, told reporters at the time: "There is no nice way to kill somebody in war. War is hell."
On the battlefield, there was no time to process it. Cantwell was a warrior, and this was war. He pushed forward.
The horrors piled up. He saw the twisted, charred remains of men. He fought to stay calm when several small bombs exploded under his vehicle. Inside a blood-and-excrement-smeared torture chamber in a former Iraqi headquarters, he saw a drill, hammers, pliers and rope. He imagined the screams of the victims.
Through it all, he knew he must remain focused. That was what he had been trained to do, and he did. But there were moments when he felt something gnawing at him.
He was looking for survivors near a blown-out truck when he spotted the first head lying in the sand. A second head lay nearby, one eye staring back at him, a scarf still wrapped around the remains of the neck.
Cantwell felt an overwhelming compulsion to put the men back together.
With sweaty hands, he lifted the second head by the scarf and carried it over to its former body. He grabbed the other head by the hair and placed it alongside the shoulders to which it had once been attached.
Then he climbed into his tank, and got back to the business of war.

AUSTRALIA
Cantwell was falling apart.
The nightmares arrived swift and brutal upon his return to Australia. In them, the hand summons him. He falls to his knees, helpless as the hand yanks him into the ground toward certain death.
He awoke to his own screams.
The nightly torment was relentless. He dreamed of being blown apart by land mines, of the decapitated heads. Mornings brought exhaustion and flashbacks. In public, he scanned crowded areas for exits, convinced an attack was imminent. Lightning made him jump.
The nightmares grew worse. One night, he shoved his wife Jane out of bed, pinned her against the wall and held his arm across her throat. Jane was terrified. When her husband woke up, so was he. What if he had hurt her?
He suffered alone. At the time, Australia hadn't experienced battle since Vietnam, so he was an anomaly. He hid it from his sons, wanting to protect them. He confided in Jane, but only to an extent. He worried his fear would contaminate her.
He began to live behind a mask. Every morning, he dragged himself out of bed and ruthlessly quarantined his fear into a tiny box inside his mind. He showered, shaved, slapped on a smile and adopted a confident tone: This is the John Cantwell the rest of the world will see.
The double life was exhausting. He consulted a psychiatrist, who offered a cold dismissal: Get on with your job and your life. Stop fixating on bad memories.
He slid further into depression. A year later, a psychologist diagnosed him with PTSD. Cantwell took sleeping pills at night to try and find peace.
It never came.

IRAQ
It was 2006, and the Iraq war was raging when Cantwell landed in Baghdad. Australia had sent 2,000 troops to support the U.S. and the British, and Cantwell, by then a brigadier, was deployed to coordinate operations across the country.
Despite his PTSD, he'd lobbied hard for this job. Maybe he could help, he told himself. And maybe if he returned to the place where his torture began, he could find a way to move on.
This time, though, his decisions determined whether his soldiers lived or died.
One day, he had to choose which of two groups of soldiers would travel with the only available explosives-clearing team. The group he sent out with the team had no trouble. The group he sent out alone hit a roadside bomb.
Three soldiers died. Cantwell wanted to vomit.
The violence left him in despair. He was visiting a neighborhood when a car bomb exploded. Cantwell stared at brain matter and blood sprayed across a wall. Two tiny pink sandals lay on the ground below the stain. One floated in a pool of blood, the wind turning it in a circle.
Cantwell knew the dead child's sandals would join the hand in his nightmares.
He grew bitter and disillusioned. The job left little time for sleep. When he did, the nightmares were grislier than ever.
An officer asked one morning if he was OK. Cantwell assured him: "I'm fine."
He wasn't. But before he left Baghdad, he was promoted to major general and appointed Deputy Chief of the Australian Army.

Jane was stricken by her husband's appearance when he returned home. He was exhausted and sick.
The guilt of the soldiers' deaths from the roadside bomb was eating at him. Jane tried to assure him he was not responsible. He ignored her. In his mind, it would always be his fault.
He quietly visited another psychiatrist who put him on medication. It did little to help.
The pressure of pretending was almost unbearable.

AFGHANISTAN
Cantwell stared at the two flag-draped caskets before him. Inside lay the first Australians to die in Afghanistan since Cantwell had taken command of Australia's forces in the Middle East.
They had been his responsibility. Now they were dead, torn apart in an explosion.
At their memorial, he spoke of bravery and sacrifice. Many in the audience cried. He strangled his own misery into silence.
After the service, he climbed on board the plane bound for the morgue and sat next to the caskets, thinking about the men inside. His warrior self tried to reject the nagging feeling that they had died because of him. He tried to think rationally: He had done his best.
But the line between his two selves was disintegrating. He began to cry. A friend on board asked if he was OK.
Cantwell could not answer.

AUSTRALIA
He wondered if all the bloodshed was worth it.
He was at the beach on vacation with Jane. But he was detached from everyone and everything.
There were rumors he was up for a promotion to Chief of the Army when he was summoned to the nation's capital to give his debrief on Afghanistan.
He donned the warrior mask one last time. He appeared calm, made jokes.
When it was over, his superior asked him how he was really doing.
Cantwell surrendered. He said: I am not OK. I am not sleeping. I am not who you think I am. Please tell the chief of the defense force.
Cantwell told the chief himself that he could not take the job. The chief understood.
His truth exposed, Cantwell hoped the worst was over. It was not. On a train, he was so startled by the conductor calling out for tickets that he shouted in terror. The other passengers laughed. He cried.
A psychiatrist finally asked: Had he thought of suicide?
He answered: Yes.
The pressure that had been building for 20 years was at bursting point.
Cantwell let go.

A pajama-clad woman in the psychiatric ward asked the general why he was there.
He wondered, too.
He had checked himself into this hospital, knowing he was broken. Still, he argued with himself: What is a major general doing here?
The doctors changed his medication, and he attended regular counseling sessions. One night, he only had one horrible dream ? an improvement.
He left after a week of intense treatment. A few months later, he retired. He and Jane moved to a peaceful coastal community, where he continues his therapy.
He doesn't regret his career. Australia's Defense Chief Gen. David Hurley said Cantwell's courageous decision to go public has already encouraged other members of the military to come forward with their own struggles.
But speaking out isn't easy. Military personnel often fear the stigma of mental illness will ruin their careers, and they worry that people will think they are not fit to lead, says Matthew Friedman, executive director of the U.S. Department of Veteran's Affairs National Center for PTSD.
To Cantwell, soldiers are simply not conditioned to expose their pain.
"We've instilled in them this idea of physical and mental toughness ? that's how they win battle, that's how we win wars," Cantwell says. "We expect that same person with the self-image of a warrior ? someone who is tough and imperturbable and able to shrug off pain and difficult environments and horror and get on with their job ? suddenly we expect them to turn around and open up? It just doesn't work."
He sits at his computer and reaches for the mouse. There is a click as a button attached to the bracelet he wears hits the table. He wove it out of parachute cord as a reminder of the 10 men who died under his command in Afghanistan.
He insists the bracelet is not a punishment but a mark of respect.
Maybe it is both.

His answer is now honest: Not good.
His sleep has been tormented by the usual nightmares. Upon waking, he sees the headline that another Australian soldier has died in Afghanistan.
His stomach drops. He knows these feelings may never go away. He hopes he can eventually forgive himself for the men who died under his command. But he never wants to forget.
"One day I'm hoping to be able to touch on these emotions, experience them and yet not let them get their hooks into me," he says. "That'll come one day. One day."
Until then, he will focus on rebuilding himself ? his real self. He wants to learn to sail and scuba dive. He wants to write and paint and draw ("something a bit creative rather than destructive," he says with a chuckle.) Maybe he'll work with veterans, or become a mental health advocate.
Not long ago, he turned 56. He wanted to celebrate with a trip to the beach, but driving a car brings flashbacks of car bombers in Iraq. So he and Jane hopped on his motorcycle and roared down the road. At a surf club, they grabbed seats on the deck. The general clutched a cold beer.
"Life is pretty good," he thought, watching the waves roll in. "Despite everything ? life is pretty good."

Scientists at the U.S. Department of Energy have created a solar cell that can convert 44 percent of sunlight hitting it into electrical energy, setting a new record for solar cell?efficiency. But it was only achieved by multiplying the power of the sun by nearly 1,000.
The ongoing research is being done at the III-V Multijunction Photovoltaics group at the Department of Energy's National Renewable Energy Laboratory, where the previous record of 43.5 percent was set. So while it's not a huge leap in efficiency, it's still a record.
The researchers achieve these high efficiencies by stacking multiple "junctions" into a single solar cell, each of which absorbs light at a slightly different wavelength. The "III-IV" in the name refers to the fact that the elements used?come from the third and fifth columns of the periodic table.
A new material with many desirable properties was?discovered by accident (gallium arsenide diluted with nitrogen), but proved extremely difficult to manufacture. Researchers needed to use a technique called molecular beam epitaxy to minimize impurities in the material ? but no one in the world could do it.
Solar Junction, a company started by researchers from Stanford University, decided to take up the challenge. With a few million dollars in funding, Solar Junction and NREL managed to make the new process work. The result was the "SJ3" cell, which has been breaking records ever since.
The catch is that it's not like a traditional solar cell, which simply receives sunlight on its surface and creates a modest charge from the photons. The SJ3 cell requires the power of the sun to be multiplied by special lenses, creating a beam of light hundreds of times brighter than ordinary sunlight.
In this kind of system, the power is measured in "suns": A beam 10?times brighter than the sun would be described simply as 10 suns. And?the previous efficiency record was set by a lens system that created 415 suns. The latest record was set using 947 suns.
Naturally, one may wonder if such a design is practical ? after all, how often does the sun shine a thousand times brighter than normal? But the lenses actually take normal sunlight that might have hit in a diffuse way on normal cells and concentrate it onto the more efficient SJ3 cell. So in the end it's just using the same area of sunlight in a different way.
The NREL emphasized in the report describing the record that the SJ3 design can easily replace solar systems used in satellites and other space-bound machines ? but it's lighter and more efficient, reducing rocket load and allowing for more onboard electronics.
What's next? Tweaking the design to include a germanium layer used previously could raise efficiency as high as 50 percent ? definitely?a major landmark in solar power, if researchers?can achieve it, although applying it to everyday power needs is another project?altogether.

After a roller coaster week, Kendra Skaggs sat down to vent on her blog. She had used that space to document her 13 month journey of adopting a young girl named Polina from Russia. But now, with that dream just weeks away from fulfillment, she described her frustration, fear and anger as she watched it being snatched away.
"I have no control. I'm on the other side of the world and I can't hold and comfort my daughter as I wait to hear if we will forever be separated," she wrote in a passionate entry
Her writing seemed to speak for hundreds of American parents whose hopes of adopting a Russian orphan were dashed today when Russian President Vladimir Putin signed into law a controversial ban on adoptions to the United States. The move is part of Russia's retaliation for a set of human rights sanctions passed by the U.S. Congress and signed by President Obama earlier this month. Critics, including the U.S. State Department, say the adoption ban is playing politics with the lives of children.
Russia is the third most popular country for Americans to adopt from, but in recent years the issue has become a political football in Russia. Americans have adopted over 60,000 Russian children since the fall of the Soviet Union, but Russian officials have seized on the cases of 19 children who died after being adopted by Americans.

The bubbly 5-year-old suffers from spina bifida, a condition that has left her numb from the waist down and unable to walk. They showed Polina photos of her new bedroom and told her about her new family. They played together, hugged each other, and promised to see each other soon when they returned in January to bring her home to Arkansas.
The adoption ban legislation, meanwhile, had just been introduced by Russian lawmakers. Kendra had hoped their case, which was nearly completed, would sneak in under the wire. She held out hope again after a Moscow court approved her adoption on Monday. All that was needed was a 30 day waiting period before they could bring Polina home.
It appears even that was too late. The law goes into effect on Jan. 1, but Russian officials have said even cases of 52 children who are within weeks of traveling to the United States are now frozen. Authorities have pledged to find new homes for them in Russia.
For the Skaggs family, it is agonizing to be so close to bringing her home, yet so far. Kendra fears Polina will think she was abandoned again.
"It's the fear of what she is going to think, that we forgot her," she said in an interview with ABC News.
"She's out there and I can't take care of her," she said, crying softly. "I can't help her. I can't tell her I love her. So it's really hard."
She also worries what will happen to Polina in Russia, a country with scarce accommodations for the handicapped.
"Russia really isn't set up for people with disabilities. You can't get into the metro even to get around because it's just levels and levels of stairs that you have to go up and down and there's no handicapped access to the buildings," Kendra said.

Over the years I have noticed that my relative lack of home repair skills can be very costly. Not only that, but the quality of the job of a pro seems to leave a lot to be desired. My home is not in any disrepair, but I would love to learn some home improvement skills. I am just not sure where to begin to learn these. Unfortunately, my own dad was not much of a teacher when to comes to DIY. For example, my wife would like a remodeled bathroom. Anybody have any suggestions where to best start learning these skills? Sex, drugs, rock 'n' roll and the Apocalypse: 2012 had it all. But only 10 stories about the past year's strangest scientific research can make it into our Weird Science hall of fame???so we're going to need your help.
Past winners of the Weird Science Awards include glow-in-the-dark kittens and puppies, a 2,700-year-old marijuana stash, meth-crazy fruit flies, reattached rabbit penises and the corpse-dissolving machine. The Maya apocalypse came in for honorable mention last year, but this could be an even bigger year for end-of-the-world weirdness.
There are lots of other contenders from 2012, however. It's hard to beat the story about the sex-starved flies who drowned their sorrows in alcohol while researchers watched. That covers sex and drugs. It also can make you feel sorry for the scientists who had to watch all that fly-sized heartbreak. (They might want to compare notes with the researchers who studied why alcohol makes people feel good.)
The sixth annual Weird Science Award competition follows the precedent we've set in past years: We offer up 30 nominees from the past year, and it's up to you to pick the top 10. We've included one of the studies that won an?Ig Nobel award. honoring for "research that makes people laugh ? and then think." That's a fine criterion for the Weirdies as well. Or you can go with research that makes you laugh ? and then makes you wonder, "What on earth were they thinking?"

Singing is a perfect way to ring in Christmas Day, but who knew it would be coming from TODAY's Matt Lauer and "Les Miserables" star Sacha Baron Cohen?
Baron Cohen spoke with Lauer on Tuesday, but not before the actor began crooning, "I am contractually obligated to do this whole interview in song." Baron Cohen plays?corrupt innkeeper Monsieur Thenardier in the film, and like all of the actors, sings all of his lines in the movie.
He noted (after returning to his usual spoken voice) that "Les Miserables" is "a staple in London," and when he was 20, he gave a stab at being in the chorus. "I passed the singing bit," he noted, but fell down when it came to the dancing part. Not that he didn't give it a good try: "There's like 200 people standing outside in the rain (at the audition), and then it came to the dancing bit ... and you had to learn a routine and it was clear I had absolutely no idea how to do it," said Baron Cohen. "So when it came time for action ... I decided to freestyle."?
He did not get the job. "I failed," he added.
Not so in "Les Miserables," where there's a lot of singing (and minimal dancing). By the end of the interview, Baron Cohen was back to singing -- and so was Lauer. Check out the video for the rest!

Nearly half of the 700,000 cancer patients who undergo surgical removal of a primary tumor each year suffer a recurrence of their disease at some point, and many of those patients will eventually die from their disease. The traditional view of recurrent tumors is that they are resistant to therapy because they've acquired additional genetic mutations that make them more aggressive and impervious to drugs. Now, however, researchers at the Perelman School of Medicine at the University of Pennsylvania show in an animal model that the enhanced aggressiveness of recurrent tumors may be due to changes in the body's immune response.
The findings are published this week in the Proceedings of the National Academy of Sciences.
"Typically when a patient has a tumor recurrence, their oncologist treats them, much like they treated them for the primary tumor -- with drugs aimed at the tumor cells themselves. But we've found that it might be better to attack the tumor cells and knock down the bad immune cells that are protecting the tumor," says senior study author Sunil Singhal, MD,assistant professor of Surgery and director, Thoracic Surgery Research Laboratory at the Perelman School of Medicine.
To assess the impact of anti-cancer vaccines on primary and recurrent tumors, the researchers immunized mice that had a primary or a recurrent tumor in their flank. Although both groups of animals developed an immune response to the vaccine, only the primary-tumor animals showed tumor shrinkage in response to the vaccine. The recurrent tumors appeared unaffected by the vaccine response. Moreover, this pattern held for several different vaccines.
Despite the prevailing models of tumor recurrence -- which emphasize genetic changes in the tumor cells themselves -- Singhal and colleagues could not find substantial genetic or behavior differences in the recurrent versus primary tumors that might account for the pattern of response.
By contrast, when the team looked at the types of immune cells in and around the tumor, Singhal's team saw a big difference. The recurrent-tumor mice had a large increase in the number of regulatory T cells, compared with primary-tumor animals. That could be important, says Singhal, because T regulatory cells are responsible for holding other immune cells in check and blocking immune responses.
Additionally, macrophages that protect the tumor cells from immune system also increased in number and activity in the recurrent-tumor animals.
Remarkably, when the researchers treated recurrent-tumor animals with drugs that block macrophage activity, tumor growth slowed significantly. However, the same drugs had no effect on primary-tumor animals.
Singhal says it is not clear exactly what triggers the immune system changes, but whatever it is appears to happen at the time of surgery. His group has already started looking for alterations in signaling molecules.
In the meantime, though, he notes that there are newly approved drugs and experimental agents that block regulatory T cells. Given his team's new results, he thinks testing these agents in patients with recurrent disease -- in combination with drugs that attack the tumor cells themselves -- could be an important advance for patients.
"We could impact the outcomes of as many as 250,000 patients a year, if this strategy works," he said.
Other authors from Penn include first author Jerrod Predina and co-authors, Evgeniy Eruslanov, Brendan Judy, Veena Kapoor, Guanjun Cheng, Liang-Chuan Wang, Jing Sun, Edmund K. Moon, Zvi Gregorio Fridlender, and Steven Albelda.
Funding for the study came from a National Institutes of Health Paul Calabresi Scholarship, the Lavin Family Foundation, and the National Lung Cancer Partnership.

WEBSTER, N.Y. (AP) - An ex-con gunned down two firefighters after luring them to his neighborhood by setting a car and a house ablaze early Monday, then took shots at police and committed suicide while several homes burned.
Authorities used an armored vehicle to help residents flee dozens of homes on the shore of Lake Ontario a day before Christmas. Police restricted access to the neighborhood, and officials said it was not clear whether there were other bodies in the seven houses left to burn.
The sister of the gunman, who lived with him, was unaccounted for. The gunman's motive was unknown.
The gunman fired at the four firefighters when they arrived shortly after 5:30 a.m. at the blaze in Webster, a suburb of Rochester, town Police Chief Gerald Pickering said. The first police officer who arrived chased the suspect and exchanged gunfire.
He lay in wait outdoors for the firefighters' arrival, then opened fire probably with a rifle and from atop an earthen berm, Pickering said.
"It does appear it was a trap," he said.
The gunman, William Spengler, had served more than 17 years in prison for beating his 92-year-old grandmother to death with a hammer in 1980 at the house next to where Monday's attack happened, Pickering said at afternoon news conference. Spengler, 62, was paroled in 1998 and had led a quiet life since, authorities said. Convicted felons are not allowed to possess weapons.
Two firefighters, one of whom was also a town police lieutenant, died at the scene, and two others were hospitalized. An off-duty officer who was passing by was also injured.
Another police officer, the one who exchanged gunfire with Spengler, "in all likelihood saved many lives," Pickering said.
Emergency radio communications capture someone saying he "could see the muzzle flash coming at me" as Spengler carried out his ambush. The audio posted on the website RadioReference.com has someone reporting "firefighters are down" and saying "got to be rifle or shotgun - high powered ... semi or fully auto."
Spengler lived in the house with his sister and mother, Arline, who died in October. He had originally been charged with second-degree murder in connection with grandmother Rose Spengler's death but pleaded guilty to a reduced charge of manslaughter.
The West Webster Fire District learned of the fire early Monday after a report of a car and house on fire on Lake Road, on a narrow peninsula where Irondequoit Bay meets Lake Ontario, Monroe County Sheriff Patrick O'Flynn said.
The fire appeared from a distance as a pulsating ball of flame glowing against the early morning sky, flames licking into treetops and reflecting on the water, with huge bursts of smoke billowing away in a brisk wind.
Two of the firefighters arrived on a fire engine and two in their own vehicles, Pickering said. After Spengler fired, one of the wounded men managed to flee, but the other three couldn't because of flying gunfire.
A police armored vehicle was used to recover two men, and eventually it evacuated 33 people from nearby homes, the police chief said. The gunfire initially kept firefighters from battling the blazes.
The dead men were identified as Police Lt. Michael Chiapperini, 43, the Webster Police Department's public information officer; and Tomasz Kaczowka, also a 911 dispatcher, whose age was not released.
Pickering described Chiapperini as a "lifetime firefighter" with nearly 20 years in the department, and called Kaczowka a "tremendous young man."
The two wounded firefighters, Joseph Hofstetter and Theodore Scardino, were in guarded condition in the intensive care unit at Strong Memorial Hospital, authorities said. Both were awake and alert and are expected to recover.
Hofstetter, also a full-timer with the Rochester Fire Department, was hit once in the pelvis, and the bullet lodged in his spine, authorities said. Scardino was hit in the chest and knee.
At West Webster Fire Station 1, there were at least 20 bouquets on a bench in front and a bouquet of roses with three gold-and-white ribbons saying, "May they rest in peace," ''In the line of duty" and "In memory of our fallen brothers."
A handwritten sign says, "Thanks for protecting us, RIP." Two candles were lit to honor the dead.
Grieving firefighters declined to talk to reporters. A memorial vigil was planned for early Monday evening.
The shooting and fires were in a neighborhood of seasonal and year-round homes set close together across the road from the lakeshore. The area is popular with recreational boaters but is normally quiet this time of year.
"We have very few calls for service in that location," Pickering said. "Webster is a tremendous community. We are a safe community, and to have a tragedy befall us like this is just horrendous."
O'Flynn lamented the violence, which comes on the heels of other shootings including the massacre of 20 students and six adults at Sandy Hook Elementary School in Newtown, Conn.
"It's sad to see that that this is becoming more commonplace in communities across the nation," O'Flynn said.
Gov. Andrew Cuomo said the State Police and Office of Emergency Management were working with local authorities.
"Volunteer firefighters and police officers were injured and two were taken from us as they once again answered the call of duty," Cuomo said in a statement. "We as the community of New York mourn their loss as now two more families must spend the holidays without their loved ones."
Webster, a middle-class suburb, now is the scene of violence linked to house fires for two Decembers in a row.
Last Dec. 7, authorities say, a 15-year-old boy doused his home with gasoline and set it ablaze, killing his father and two brothers, 16 and 12. His mother and 13-year-old sister escaped with injuries. He is being prosecuted as an adult.

As a major storm with 70- to 80-mile-per-hour winds threatened to bear down on the Deep South early Wednesday morning, Mississippi officials encouraged residents to bring in their outdoor Christmas decorations for fear they could become dangerous projectiles.
?We understand that most people will be focusing on the holiday,? Mississippi Gov. Phil Bryant said in a statement. ?Please plan now for how you will receive a severe weather warning and know where you will go when it is issues.?
The storm comes from the West, where it dumped up to six feet of snow in the mountains of California.

The storm threatens to throw up similar travel obstacles in the South, where it is forecast to bring ?severe thunderstorms capable of damaging winds and tornadoes,? according to weather.com. Rain and thunderstorms are also predicted to hit Jacksonville, Charlotte and Orlando on Christmas Day, according to weather.com.
The storm should rev up over Texas and sweep east into Mississippi. Thunderstorms are expected to develop during the morning hours of Christmas Day, around 3 a.m., lasting until about noon, according to The National Weather Service.
?There are enough conditions working together to increase the threat for severe weather on Christmas Day,? the Weather Service said, adding that the main threat exists from the Houston area northward to College Station. ?Residents of Southeast Texas are encouraged to monitor forecasts for updates.?
Later in the day, three to six inches of snow are expected in northern and western Arkansas, according to the Weather Service. One to three inches are forecast elsewhere in the state, although no accumulation is expected near the border with Louisiana.
Before the storm reaches the South, however, it is forecast to cover the roads in Salt Lake City with snow on Christmas morning, weather.com reported. Fresh snow is also expected to blanket parts of the adjacent High Plains, including Denver. ?
Holiday travel impacts

Passage is a victory for Islamist President Mohammed Morsi, but a costly one. The bruising battle over the past month stripped away hope that the long-awaited constitution would bring a national consensus on the path Egypt will take after shedding its autocratic ruler Hosni Mubarak nearly two years ago.
Instead, Morsi disillusioned many non-Islamists who had once backed him and has become more reliant on his core support in the Muslim Brotherhood and other Islamists. Hard-liners in his camp are determined to implement provisions for stricter rule by Islamic law in the charter, which is likely to futher fuel divisions.
His liberal and secular opposition, in turn, faces the task of trying to organize the significant portion of the population angered by what they see as attempts by Morsi and the Brotherhood to gain a lock on political power. The main opposition group, the National Salvation Front, said it would now start rallying for elections for the next lawmaking, lower house of parliament, expected early next year.
"We feel more empowered because of the referendum. We proved that at least we are half of society (that) doesn't approve of all this. We will build on it," the Front's spokesman, Khaled Daoud, said. Still, he said, there was "no appetite" at the moment for further street protests.
Saturday's voting in 17 of Egypt's 27 provinces was the second and final round of the referendum. Though the constitution is widely expected to pass, the key questions will be over turnout and the margin of victory. Preliminary results from the first round a week ago showed only 32 percent turnout and a relatively low edge of 56 percent for the "yes" vote. Preliminary results from the second round are expected to emerge by early Sunday.
The new constitution would come into effect once official results are announced, expected in several days.
In a sign of disarray in Morsi's administration, his vice president and ? possibly ? the central bank governor resigned during Saturday's voting. Vice President Mahmoud Mekki's resignation had been expected since his post is eliminated under the new constitution. But its hasty submission even before the charter has been sealed and his own resignation statement suggested it was linked to Morsi's policies.
"I have realized a while ago that the nature of politics don't suit my professional background as a judge," his resignation letter, read on state TV, said. Mekki said he had first submitted his resignation last month but events forced him to stay on.
The status of Central Bank Governor Farouq el-Oqdah was murkier. State TV first reported his resignation, then soon after reported the Cabinet denied he has stepped down in a possible sing of confusion. El-Oqdah, in his post since 2003, has reportedly been seeking to step down but in recent weeks the administration was trying to convince him to stay on. The government is eager to show some stability in the economy as the Egyptian pound has been sliding and a much-needed $4.8 billion loan from the IMF has been postponed.
Over the past month, seven of Morsi's 17 top advisers and the one Christian among his top four aides resigned. Like Mekki, they said they had never been consulted in advance on any of the president's moves, including his Nov. 22 decrees, since rescinded, that granted himself near absolute powers.
Those decrees sparked large street protests by hundreds of thousands around the country, bringing counter-rallies by Islamists. The turmoil was further fueled with a Constituent Assembly almost entirely made up of Islamists finalized the constitution draft in the dead of night amid a boycott by liberals and Christians. Rallies turned violent. Brotherhood offices were attacked, and Islamists attacked an opposition sit-in outside the presidential palace in Cairo leading to clashes that left 10 dead.
The turmoil opened up a vein of bitterness that the polarizing constitution will do little to close. Morsi opponents accused him of seeking to create a new Mubarak-style autocracy. The Brotherhood accused his rivals of being former Mubarak officials trying to topple an elected president and return to power. Islamists branded opponents "infidels" and vowed they will never accept anything but "God's law" in Egypt.
